The Copyright Claim Chronicles Continue - Silva Hound "Hooves Up"


The Copyright Claim Chronicles continue, as yet another #horsefamous creation gets a message. This time around it's Silva Hound (or rather Seventh Element, remixing Silva Hound) and the original song "Hooves Up High" featuring RinaChan. This afternoon Silva tweeted an image of the copyright claim notice from Hasbro on Youtube.

This is NOT a take-down notice however. This is, interestingly enough, a message indicating that Hasbro is now allowed to make money off the ad revenue on the video if it stays up, and that the respective channel is not allowed to do so.

The most curious part of the situation is that it is not clear what part of the video could possibly be claimed. It is not using musical assets from the show, and the image in use is a grayscale picture with loosely defined blob-like silhouettes in the corners. Some say that these corner images are the culprits, but it would be difficult to see why this, out of any other video with plainly-obvious ponies in usage could possibly be targeted for a claim.



Hasbro can make money on things that aren't even theirs now - wonderful.

    Making idle threats and acting like a fucking ghetto piece of shit is a good way to ensure (A) You lose and (B) giving them more fuel for their rampage. Good job, you selfish money-grubbing Jew. I've had a few videos demonitized because YOUR songs (playing via PVL in background) ContentID'd. One song in a sea of several dozen or more per tutorial video where my watchers wanted to listen to Brony music. I'm not really mad, but I was frustrated. The paradigm of brony music into money-grubbing was a bit of a shock I didn't see coming.

    Seriously, though, SilvaHound is correct that this is bogus, but he's facing an uphill battle. It's the same "i've got more money to holdout in a legal battle" issue that has plauged the IP law for a long time. You aren't going to win if they get malicious, and acting immaturely is a good way to not get on their good side.

    4. Except this isn't their IP. If you weren't a brony, you might not even know that this was fan content. Hasbro owns absolutely nothing in that video, or videos like it. They're making money on something that's not there's (ie, stealing from their fans)

      I talked with Silva Hound's manager about this issue (your videos being ContentID flagged for his music) and he responded that some of his songs are published via iTunes or Spotify, which automatically submits them into YouTube's ContentID system, without giving him (or Silva) any control over how this happens.

      Silva Hound's music is all licensed as Creative Commons, however, which means you'd actually be in the clear to use it in your videos. You can use YT's copyright dispute feature, check "I have permission to use this content", and when it asks you to supply the license, use this URL:

    And what IP would that be? Try listening to the song before commenting - unless Hasbro owns a trademark on the word "Hooves", there isn't any.

    The lyrics and background music are original, there are no references to any MLP characters or other MLP IP, there's no sound clips from the show, etc.

  5. I have a feeling based on usual processes that YouTube uses with corporate claims that they literally just took everything that popped up. A lot of this is probably done by folks in legal or compliance, and they probably aren't super familiar with every aspect of the IP, they won't know any better.

    My prediction; This claim is bullshit, it will eventually be resolved, until it's resolved it will continue to be bullshit.

    1. People seem to love the jump on the "IT WAS HASBRO'S FAULT!!!" bandwagon when Youtube ID system has had a history of fucking EVERYONE over. There was one person who legally bought one of the music packs or FX packs that you can use in videos and even he got blasted with a Copyright.

  8. That's not how copyright law works. If I wrote about the Columbine massacre, focusing on the shooter's lives, should that money go to their parents? IP law is fucked, this shit is okay, and Hasjew doesn't need more cash. Plenty retards are giving that to them, and this video essentially promotes giving more cash to the Hasjew.
