ILoveKimPossibleAlot's Horselaber >For free requires a NDA/Contract? (Drama Series)

Well, it's been a while since we've had a good drama article, and the first one in which the drama well goes so deep that it spans more than just one article, and we aren't even done. This section focuses on the practices by ILoveKimPossibleAlot, a prolific member of the Brony Analysis Group known as the Rift Café, to which she is a high-esteemed member.

It all started innocently enough on Twitter, when user Minty Root tweeted about how working for Brony Analyst and lifelong John De Lancie stalker number one fan, ILoveKimPossibleAlot requires a 7-Page Non-Disclosure Agreement, or NDA for short.

https://twitter.com/Minty_Root/status/756693605075578881

This naturally started a chain reaction of questions of people trying to figure out just what the sitch is, such as what the NDA entails. You can read the full unfettered NDA required of all project workers, working under ILoveKimPossibleAlot, here in all its glory. We will go over some of the more pertinent parts, starting with the header.

The first thing one notices is the usual NDA stuff such as not agreeing to leak secrets, and all the normal stuff one would find within. While it is not unusual for most projects of large scopes to have some form of a non-disclosure agreement as to protect secrets from getting out to the public at large, the way this one is set up turns it into what looks like more of a contract rather than a simple NDA. In other words, it seems to overstep its own bounds by kilometers.

In a normal Non-Disclosure Agreement, this probably would be sufficient material, but one notices that it quickly goes from a simple Non-Disclosure Agreement to a full on work contract.
Important bits include a 5-hour work week minimum required of all who sign up for the task of working for her:

And do not be lulled into thinking that real life has any bearing either when the Project(s) are at stake. If you happen to have a family accident, or something as simple as a paper due at Uni - which should and would obviously take priority over any fandom hobby work. Such breaks must be requested and approved by the higher ups before taking on real world tasks.

Should any emergency or even a computer problem arise, it is expected of you to notify project leads first before any thing else arises, and in the case of computer failure and your inability to fix it within two months time, to find your own replacement to take over whatever work you may have had. Nothing is mentioned on whether you would still get credit for the work you've done, but assumed. That is to say, if one gets fired from the team, nothing in the NDA states whether that person will still receive credit for the work they've done, or if their replacement will take on the credit.

A hierarchy exists to keep things together, in which one is not allowed to contact the Great Leader Kim Jong Possible herself unless one has the permission from one's respective Project Heads.

The Hierarchy System is done in practice by Skype (which has since been surpassed in almost every way save for video conference calls by DiscordApp) in which members of a project are required to change their display name, which not only shows in the project's Skype chat, but for all Skype chat groups that person belongs to, to something that reflects that they work for Not Possible, and what they do. In other words, they proudly display for every single one of their contacts, that they are under the mercy of  Supreme Glorious Leader Kim Jong Possible.

A firing and a three-strike system exists, for those who do not follow the direct orders from Kommissarin Possible. Should any rules be broken, offenders are awarded a strike.

One stipulation of this NDA is how project files and Flash puppets are handled.

She claims ownership of any and all assets of whatever project is being worked on, which is ironic because a lot of the Flash rigs used in her now privatized video "Let's Go Meet John De Lancie" are taken from DHX/Hasbro owned Flash puppets themselves. All that remains of the video are reaction videos to it and the song portion.

When she considers about the fact that stolen puppets were used, the excuse suggested by her was that of ignorance, and if confronted about it at a convention - they will simply sweep that under the rug as if it is no big deal.

That's some pretty damning evidence right there if I do say so myself.

This hierarchy system isn't without reward, however. Those who meet the extensive list of requirements may have the honor of appearing as a secondary >literally who guest on one of Kim-Is-Impossible-To-Work-With's panels at various My Little Pony conventions.

Minty Root
Meaning that those who go to conventions have their own name, plus KP's seal of ownership over them.

Now, at this point you may be thinking - this doesn't seem quite out of the ordinary for a paid project - and that's just it. None of the aforementioned work is paid by monetary compensation - despite that, all who work for ILoveCommunismAlot are required to follow all of the aforementioned rules
>for free.
And if it weren't pointed out before, the person has to sign this document more than once, on both the top and bottom portions of it, just to seal the deal that by signing it - you have signed away your life, time, freedom, and possibly your first born to Satan ILoveControllingPeopleAlot.
Yikes! All of this would sound plausible if this NDA were part of an actual company that pays their employees, but as this is not the case it is very extreme. Especially considering that this is all for fan-made works of My Little Pony.

Ironically enough, in this video straight from the horse's mouth, she complains that people who work for her complain about her because of various reasons, and she admits that due to all the aforementioned, especially the hierarchy and project workers not allowed to talk directly to her; that she doesn't even remember who they are. Well, shit, it's no wonder you have such problems getting on a personal level with the people who work with/for you. KP, if you read this, you should probably go back over the advice that Dr. Wolf gives out, as it is actually pretty sage advice on how to manage a team. You clearly have missed those messages.

  1. Another young creator with little real-world work experience thinking that ridiculous bureaucracy and taking yourself way too fucking seriously are the same things as being "professional". Pro tip from someone in the fandom with an actual career: those things make you a dick in the work world too.

  6. So to TL;DR:

KP is giving a corporate styled NDA to volunteer workers?

    ReplyDelete
  7. I think this really need the "Too stupid to make up" tag. This is ridiculous. I knew "horsefamous" people had huge egos, but I never would have imagined that it could go to one's head in such as fantastically hilarious yet disturbing way.

Plus, with all the "leaked" stuff (again can you really call it a "leak" when people are doing volunteer work to draw colored horses?), it's clear KP as a person is, at best, an extremely manipulative liar, and at worst a full blown sociopath.

  9. Well, it's isn't it technically the fault of those who signed up? I get the disagreement with KP's methods, but this is purely overblown at this point. I was never a big fan of hers, but it looks like people are looking for someone to lynch. :/

    1. She promises recognition which can be very, very enticing for fledgling artist/musician, etc. But ultimately, yes, this is volunteers' own faults for agreeing to such retarded terms.

      Delete
    2. She still deserves to be mocked for this though. This is egoistical as shit.

      Delete
    3. Why does having an ego result in needing to be mocked? Why does that have to be a qualifier? Say what you will, but a majority of humans have an ego of some sort. Some may have a bigger ego, but even so it's a sign of humanity. Granted she still is young and maybe she will take some maturity lessons here, but the eagerness of people to really go after her is quite disturbing.

      Delete
    4. In my experience with other drama (that no one cares about because those places were disowned by the fandom a long, long time ago) it's more of a sort of cumulative effect. If this was something that was like, two weeks, a month and this happened it wouldn't be much. The problem is that it's been going on for what is presumed at least three years and there is a lot of energy pent up in those years. That's why people are after her.

Well that and she's been exploiting these people for three years or more.

      Delete
    5. I think a lot of people working for her would be reluctant to quit in the middle of a large project for: 1) making life harder for their fellow volunteers, 2) the potential negative feedback the content creator would give, and 3) causing you to be blacklisted from future projects with others.

I always thought that the animations of herself and her obsessive love for Discord were paid, but, the team doesn't receive nothing? How has begun all of the team? I still can't believe that "Code of Conduct".

I thought about it pretty hard and decided I didn't really want to volunteer for a group that had so many rules and regulations. There should usually be an aspect of fun in volunteering, and threatening "firing" right away in the code of conduct was pretty telling.

    ReplyDelete
  21. So what I'm picking up here.
-She made a NDA/contract for her crew.

-The volunteer musicians and artists signed this and then didn't like it so they are crying victim. Despite the fact it's their own dumbass fault.

    Sound about right?

So basically the Brony fandom is looking for someone to lynch, like always.
For lords' sake guys, grow up.

    ReplyDelete
    Replies
    1. I don't think you have any business invoking the Lord here to urge people to grow up.

      Delete
    2. As far as I've been able to discern the NDA was not a day 1 thing and from the articles it's been my understanding said contract (probably interchangeable with the NDA at this point) was only required as of the last year or so.

The first projects she finessed people to do her bidding and it's only gone business as of late. At least, that's what I've understood.

      Delete
  22. So i worked with her for about a year. and I am sad to say that yes this is all true. Around April I received an email stating that i had to sign a contract to continue working with them, and knowing this was a volunteer thing I refused. What followed was a short conversation with one of her editors stating that in order to continue working with her i HAD to sign it. when i refused to again they "fired" me. I honestly hope she didn't get many people to actually sign that but most of her crew was younger and probably not as wary of contracts as I am so who can say. Either way I was glad to be done with it...

    ReplyDelete
    Replies
    1. Seeing as how you didn't sign any NDAs, what were you working on up until being "fired"? Was it mostly animation rigging, or were there any writing duties to be filled?

      Delete
    2. animation stills, backgrounds, that kinda stuff. Mostly just stuff i did for fun. To tell the truth i enjoyed working on it, but communication issues combined with this contract business turned me off of the whole thing.

That being said, I hope I don't sound too bitter, I just don't agree with contracts for pro bono work. which is what I said to the person I talked to.

      Delete
    3. Well, it sounded like a pretty tight operation that produced at least one animation, if nothing else. The only other project, Double Rainboom, employed a class of students for a university project that spanned roughly an entire episode.

Too bad the end result was full of memes and not very well written.

      Delete
  23. But now we have the question: who the fuck agrees to this shit? Sounds like your own fault when signing a contract like this.

    ReplyDelete
  24. what idiot would sign an NDA like this anyway? Or sign a "work for hire" with no pay? And BTW, her name is even a trademark. Maybe Hasbro and Disney could partner to give her simultaneous Cease and Desist. She better get her attorneys to review these documents

    ReplyDelete
  25. I have to say KP would have made a great project manager/team lead in a corporate environment. But her youtube channel and her videos are hardly necessitating corporate level management. You dont need "team managers" and such for a youtube channel. This is classic micromanagement and while this can work in a development department on a large corporate level, it doesnt work in the small scale of a sole proprietorship such as a youtube channel.
Not to mention, what strikes me as off about this whole contract, is that it states there are minors on the team. Minors arent legally able to sign NDAs or contractual relationships. They must have the signature of a parent or guardian, and I see nowhere on these for a parent or legal guardian signature.
There's a HANDBOOK for joining the artistic team for a youtube channel? For which these people get no recognition in the credits of the videos, and only headache and heartache? And no pay? I see a lot of "horse famous" people saying "hey can you animate, can you draw, can you voice act, I want to work with you, apply here for a position on my team". And the only compensation "might" be after possibly years of work is a con ticket?
All of this micromanagement just for volunteer work without any of the promised benefits. She lost a fan in me

    ReplyDelete
    Replies
    1. It doesn't say it on what's shown here, but I would presume that younger participants would be asked to find someone to cosign (like a parent or an older sibling); a cosigner is typically someone who'd be held liable in case of damages and who may have some obligation to help uphold a contact/agreement.

Assuming they're using the term correctly, that line *isn't* for someone who's already in IKantPossiblyBeSerious's "management" team who might sign as a witness, but rather for someone who can be there to make the agreement official in the case that the volunteer can't do that themselves.

  26. This article mostly just seems to me like the author reeeeeeeeeeeeeeeally wants to tear somebody down, and, lacking any evidence of actual bad conduct or wrong doing, decided to just post up a whole bunch of stuff and then jump through hoops to paint it in the the worst possible light they could conceivably contort into.

I honestly don't see where the problem is here. Anyone who's ever worked on a project of any degree of complexity knows that things can go off the rails in a hurry if you don't have /some/ kind of structure and a clear definition of expectations from contributors. This is true regardless of if the project is a paid business venture or hobbyist labor of love. If people say they are going to contribute a certain amount of effort, and then consistently don't, everyone else has to constantly scramble to make up the slack, and making up for that person eventualy becomes more effort than just not having them around.
Reading the posted sections of the document (without the hyperventilating rage-froth trying to distort it), it actually seems like an extremely lax, friendly, and accommodating document. Plenty of allowances are made for real life getting in the way, all they ask is that you let someone know about the delay so they can coordinate with others on the team. And even in the most extreme case, the worst action they can take for misconduct or a violation of the agreement is to... no longer allow that person to work for free on the volunteer project for which they volunteered, for free. OH NOES! D8

I work as an engineer by day, and I've been a part of plenty of group projects in my spare time, and I have to say this is total kittens and rainbows. I've had to sign more agressive documents to be allowed to use a photocopier before. (True story, BTW)

Honestly, this entire article is nothing but a drama-llama farmer parading his herd of certified-organic artisanal drama-llamas through town just to see if he can sell some, while pooping on as many things as possible during the trip. Tone it down a bit, pretty please.

Don't worry fam, you'll be famous. I'll mention you at all the cons I'm invited to.

      Delete
    3. John, I think you're missing the point that contributors are not compensated in any sort of way. In fact, if you read closely the average workload is 10-20 hours per week. At least where I live 'full time' is 40 hours, give or take. So expecting people to work half that, with no pay or compensation (not even CREDIT for their work given), is a bit ridiculous. Now it's not KP's fault people bought into it but more or less the fandom is at fault for how silly it has devolved over the years.

I think the core problem lies in the fact this is a fandom about colorful little horses that is ungodly serious for something that is supposed to be an act of love. IMO If I were to make such a project I would put all the allowances on the backend to accommodate the project itself rather than the users. Though what do I know.
